abacova Terms of Service

These Terms and Conditions (the "Terms") govern the use of the website and the personal finance management application abacova (the "Service"). By registering or using the Service, you accept these Terms.
The Spanish version is the binding version of these Terms. Versions in other languages are translations provided for convenience; in case of discrepancy, the Spanish text prevails.
1. Owner of the Service
The Service is provided by Ignacio Berenguer García, sole trader (self-employed) operating under the business name abacova, NIF 07239146B. You can contact us at support@abacova.com.
2. Purpose of the Service
abacova is a tool for recording, organizing and analyzing your personal finances or those of a small organization. abacova is not a financial institution, does not provide financial, tax or investment advice, and the information it offers is of a purely informational nature.
3. Eligibility
To use the Service you must be over 18 years of age and have the legal capacity to accept these Terms.
4. Your account
You are responsible for maintaining the confidentiality of your credentials and for all activity carried out under your account. You must provide truthful information and keep it up to date. Notify us immediately of any unauthorized use.
5. Acceptable use
You agree not to use the Service for unlawful purposes, not to attempt to access the systems without authorization, not to interfere with its operation and not to use it in a way that infringes the rights of third parties.
6. Plans, payments and billing
The Service offers a free plan and paid plans. The prices and the features of each plan are indicated on the site. Payments are processed through our payment provider. Unless stated otherwise, subscriptions renew automatically at the start of each period.
7. Cancellation
You may cancel your subscription at any time. After cancellation, you will continue to have access to the paid features until the end of the billing period already paid, at which point no new charges will be made. There is no minimum commitment.
8. Refunds
Where applicable, we respect the 14-day right of withdrawal provided for by the European Union consumer regulations (which may lapse if you request the immediate commencement of the service and accept this). Outside of that case, no refunds are made, given that you can cancel at any time and retain access until the end of the paid period.
9. Availability and modifications of the Service
We strive to keep the Service available, but there may be interruptions due to maintenance or other causes. We may modify, suspend or discontinue features of the Service, informing you when the change is relevant.
10. Disclaimer and limitation of liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we do not guarantee that the Service will be uninterrupted or free of errors, nor are we liable for financial decisions you make based on the information of the Service. Nothing in these Terms excludes the liability that cannot legally be excluded, including the mandatory rights that consumer regulations grant you.
11. Suspension and termination
We may suspend or cancel your access if you breach these Terms. You may stop using the Service and close your account at any time (see also the Privacy Policy regarding data deletion).
12. Applicable law and jurisdiction
These Terms are governed by Spanish law. For the resolution of any dispute, the courts and tribunals of Madrid (Spain) shall have jurisdiction, without prejudice to the mandatory rights that consumer protection regulations grant the user, which may allow them to bring proceedings before the courts of their place of residence.
13. Changes to the Terms
We may update these Terms occasionally. We will publish the current version on this page with its date of last update. Continued use of the Service after the changes take effect implies their acceptance.
